Guardianship of a Minor in Greensboro

Practical Guidance for a Child’s Care, Property & Future

A child may need a guardian when no parent is available to make necessary care decisions or when an adult must manage property belonging to the child. Law Offices of Cheryl David guides families through court proceedings and advance planning, drawing on our work in estate planning, probate, elder law, and related future-planning matters.

A court may appoint a guardian of the estate when a child receives an inheritance, life insurance proceeds, or a lawsuit award. A guardian of the person or general guardian may be appointed when both parents have died or their parental rights have been terminated in a court proceeding.

Guardianship of a Minor

Guidance Through Each Stage of Minor Guardianship

We’ve served North Carolina families since 2000 through a practice focused on guardianship, estate planning, elder law, and probate. Our related services include trust administration, Medicaid planning, wills and trusts, and powers of attorney.

Cheryl K. David brings more than 30 years of legal experience to sensitive planning and family matters. We guide clients in Greensboro and Guilford County through guardianship proceedings and advise appointed guardians as they carry out their responsibilities.

How the North Carolina Minor Guardianship Process Works

When a child resides or is domiciled in Greensboro, the application for appointment is typically filed with the Guilford County Clerk of Superior Court. It identifies the child, explains the applicant’s relationship and interest, and states why guardianship is requested.

If the clerk makes an appointment, the guardian must follow the authority granted in the order and remains subject to ongoing court oversight.

How Parents Can Name a Preferred Guardian

A parent may recommend a guardian for a minor child in a last will and testament. If no parent survives, that nomination provides strong guidance to the clerk, although the clerk may select someone else when the child’s best interest requires a different appointment.

Standby guardianship provides another option for a parent with a progressive chronic illness or irreversible fatal illness. The standby guardian’s authority may take effect upon the parent’s incapacity, upon debilitation with consent, upon consent alone, or upon death. The written designation must be signed by the parent and two eligible adult witnesses.

We prepare wills and powers of attorney as part of our future-planning services, allowing parents to consider a guardian nomination alongside other documents affecting their family and property.
